Florida: Legality of Delta-8

What Exactly is Delta-8?

Due to the chemical differences between the two, Delta-8 contains minimal amounts of THC (less than 0.3% allowed by law). Delta-9 on the other hand goes above the legal limit.

Because of their similar names, some people might at first a little hesitant to purchase or use Delta-8. But its lower THC content means that on a federal level, it is legal! Which probably leads you to your second question…

Is Delta-8 Legal in Florida?

YES! Delta-8 is legal in Florida as long as products come in under the legal amount of THC. Because it is a federally legal substance, it is permitted in most states. Hemp once was regulated as an illegal substance under the Controlled Substances Act of 1970, but this changed in 2018 under the Agricultural Improvement Act (otherwise known as the Farm Bill). This new bill federally legalized hemp, and hemp-derived products (those that contain no more than the legal limit of 0.3% Delta-9 THC). For this reason, marijuana (Delta-9), is still treated as a controlled substance, and is illegal under federal law. Delta-8 on the other hand is derived from hemp, so it’s legal under the Farm Bill. In holding with this, the state of Florida has taken steps to specifically legalize all derivatives, cannabinoids, and isomers of hemp. This includes all tetrahydrocannabinols other than Delta-9 THC. Is Delta-8 synthetic?

Delta-8 is naturally expressed in the hemp plant, but not in high concentrations or qualities. That means it must be synthesized from extracted CBD.

The government has banned many specific synthetic cannabinoids, but currently the Drug Enforcement Agency’s (DEA) has not labeled Delta-8 as a controlled substance. Make sure to check in from time to time as they update rules and regulations.

Will Delta-8 Show up on a Drug Test?

Another common question many people want to know is if Delta-8 will show up on drug tests. The answer to that mainly depends on how much of it you consume, and how regularly. Because Delta-8 THC has similar metabolites to Delta-9 THC, there is the chance of not passing your drug test.  For this reason, we don’t recommend using Delta-8 products if you are required to take regular drug tests. And if you’ve ingested Delta-8 right before a test? Honesty is the best policy so tell your employer beforehand.
