What Exactly is Delta-8?

To talk about what Delta-8 is, let’s talk about with what it isn’t. Delta-8 THC is different from Delta-9 THC. Because Delta-8 is a minor occurring cannabinoid in the hemp plant, it only results in a mild psychoactive “high” and doesn’t carry the same mind-altering kick that Delta-9 does. The reason behind this is due to their chemical differences. Delta-8 contains minimal amounts of THC (less than 0.3% allowed by law)., whereas Delta-9 goes above the legal limit.

Is Delta-8 Legal in Alabama?

YES! Delta-8 is legal in Alabama as long as products come in under the legal amount of THC. The state has specifically legalized all derivatives, cannabinoids, and isomers of hemp. This includes all tetrahydrocannabinols other than Delta-9 THC. See Section 2-8-381 of the Alabama code for all the details.

Because hemp is a federally legal substance, it is permitted in most states. Hemp, once regulated as an illegal substance under the Controlled Substances Act of 1970, is now protected under the 2018 Agricultural Improvement Act (otherwise known as the Farm Bill). This bill federally legalized hemp, and hemp-derived products (those that contain no more than the legal limit of 0.3% Delta-9 THC). For this reason, marijuana (Delta-9), is still treated as a controlled substance, and is illegal under federal law.

Is Delta-8 synthetic?

Delta-8 is naturally expressed in the hemp plant, but not in high concentrations or qualities. That means it must be synthesized from extracted CBD.

The government has banned many specific synthetic cannabinoids, but currently the Drug Enforcement Agency’s (DEA) has not labeled Delta-8 as a controlled substance. Make sure to check in from time to time as they update rules and regulations.

Will Delta-8 Show up on a Drug Test?

So will you be safe to use Delta-8 without it showing up on a drug test? The answer to that depends largely  on how much of it you consume, and how regularly. Because Delta-8 THC has similar metabolites to Delta-9 THC, there’s a chance you might not pass.  For this reason, we don’t recommend Delta-8 products to those required to take regular drug tests. And if you’ve ingested Delta-8 right before a test? Honesty is the best policy. Just tell your employer beforehand.
