Because Delta-8 is now a federally legal substance, the answer to this question is YES. Delta-8 is legal in Illinois. Hemp used to be illegal under the Controlled Substances Act of 1970. But in 2018, under the Agricultural Improvement Act (otherwise known as the Farm Bill), the game was changed for hemp. This bill federally legalized all hemp, and hemp-derived products (that contain no more than 0.3% Delta-9 THC). Marijuana (Delta-9) is still treated as a controlled substance, making it still illegal under federal law. Since Delta-8 is derived from hemp, it’s legal under the Farm Bill, and can be purchased legally in the state of Illinois.

 

Will Delta-8 Show up on a Drug Test?

Even though we would like to give you a simple yes or no answer, it depends. By this, we mean it depends on how much Delta-8 you decide to consume (or how regularly you consume it), because it IS possible to not pass a drug test after using or consuming Delta-8 products.
