Oklahoma: Legality of Delta-8

From Broken Arrow to Bartlesville, an increasing number of Oklahomans are curious about Delta-8. If you are among their ranks, you’ve come to the right place. Read on to learn all the details about this new cannabinoid and whether you can take it legally in Oklahoma.

What Exactly is Delta-8?

We’d like to start by explaining that Delta-8 is not Delta-9–because one of these two compounds is a controlled substance while the other is not. Delta-9 (also known as marijuna) contains more than the legal amount of THC (anything over 0.3%). However, Delta-8 is expressed in the hemp plant and has minimal amounts of THC, so it is capable of coming in under the legal limit. Another difference between the two compounds is that Delta-9 results in a mind-altering high while Delta-8 creates a clear-minded “functional” high.

Is Delta-8 Legal in Oklahoma?

Yes! Oklahoma has legalized hemp and Delta-8 if they come in under that 0.3% THC limit. For more details about Oklahoma’s stance on hemp, check out Title 2. Agriculture, section 2-3-402 of the Oklahoma Statutes.

After it’s recent federal legalization under The Agricultural Improvement Act (more commonly referred to as the 2018 Farm Bill), hemp is permitted in most states. At this time, it must contain 0.3% or less THC to be legal. Because Marijuana (Delta-9) goes above the THC limit, it remains a controlled substance at this time.

Delta-8 is currently illegal in: Alaska, Arizona, Colorado, Delaware, Hawaii, Idaho, Iowa, Michigan, Mississippi, Montana, Rhode Island, and Utah. If you’re reading this article, and your state is listed above, then you might need to find alternative sources for relief.

Is Delta-8 synthetic?

Although Delta-8 is naturally expressed in the hemp plant, it is not found in high concentrations or qualities. Therefore, it must be synthesized from extracted CBD.

The government has banned many specific synthetic cannabinoids, but currently the Drug Enforcement Agency’s (DEA) has not labeled Delta-8 as a controlled substance. Make sure to check in from time to time as they update rules and regulations.

Will Delta-8 Show up on a Drug Test?

Passing a drug test after taking Delta-8, depends mainly on two factors: how regularly you take Delta-8 and how much of it you have consumed. Since Delta-8 THC contains similar metabolites to Delta-9 THC, there is some chance you might not pass. With this in mind, we advise against using Delta-8 products if you are required to take regular drug tests. And if you did ingest Delta-8 right before a test, let your employer know beforehand. Honesty is always the best policy!

What does Delta-8 have to offer?

Cannabinoid users have reported mental and physical benefits after taking hemp. Some of the more commonly observed benefits include a stimulated appetite, aid with pain and inflammation, nausea relief, and help with anxiety and depression.

Like the Delta-9 compound, Delta-8 will result in a high. However, the more mild Delta-8 cannabis strain produces a more “functional high,” meaning your mind will remain clear throughout use.
